What is the NHS Injury Benefit Scheme?
The purpose of the NHS Injury Benefit Scheme is to provide an annual income to an employee who suffers a temporary loss of NHS earnings (Temporary Injury Allowance), or a permanent loss of earnings ability (Permanent Injury Benefit), resulting from an injury or disease wholly or mainly attributable to the duties of their NHS employment. The Scheme may also pay benefits to the spouse and dependants of an NHS employee whose death has been caused by, or hastened by, their NHS duties.
Almost all staff employed by NHS organisations are covered by the Scheme from their first day of work until their last day of employment and they do not have to be members of the NHS Pension Scheme to be able to claim.
A review of the NHS Injury Benefit Scheme is currently underway. The review is being carried out in partnership between NHS employers and the NHS Trades Unions under the auspices of the NHS Staff Council. More information on the NHS Injury benefit Scheme is available on the Useful resources page
How will the transfer affect my access to the NHS Injury Benefit Scheme
If you are transferred under TUPE, the benefits provided by Temporary Injury Allowances and Permanent Injury Benefits where pay reduces but employment continues will continue to be made available to you. However, you will lose your rights to access Permanent Injury Benefits at the point your employment in transferred.
